Banks was drafted in the fifth round of the 2003 NFL Draft by the San Diego Chargers. He played in four games for the Chargers during his rookie season before being released. He was then signed to the Atlanta Falcons’ practice squad.

False accusation and imprisonment

In 2002, Banks was falsely accused of rape by Wanetta Gibson, a fellow Long Beach Polytechnic High School student. Wanetta’s mother, Wanda Rhodes, sued the Long Beach Unified School District, alleging that they did not do enough to prevent the rape from happening. The school district settled the lawsuit with Rhodes for US$1.5 million.

Banks maintained his innocence, but he accepted a plea bargain in which he would be sentenced to six years in prison and mandatory registration as a sex offender. He served five years of his sentence and was then required to spend an additional five years on parole.

In May 2012, the California Innocence Project announced that it had located the victim, who stated she had lied about the rape and asked for Banks’ exoneration. On May 24, 2012, Banks was exonerated after the Los Angeles County District Attorney’s office announced it would not retry him and he was released from custody. The District Attorney’s office determined that the victim’s story was not credible and that there was insufficient evidence to proceed with a trial.

Life after exoneration

After being exonerated, Brian Banks tried out for the Seattle Seahawks, but was not signed. In 2013, Banks was hired by the NFL as a training camp intern with the Atlanta Falcons. In 2014, he worked as a coaching intern for the Falcons during their offseason program and training camp.
